The protection of rare species abounds with scientific and ethical considerations. An ethical dilemma can emerge when the life of one species is valued higher than that of another, and so we discuss the basis of ranking, protection, and valuation of plants and animals. A duty to protect rare species exists in this age of great losses to plant and animal life, but the scientific and public communities are not always in agreement regarding what species deserve protection. Using a case (...) study, we illustrate how the decision to kill beavers to protect a rare plant and rare animals found in a tidewater creek demanded an ecological ethic approach. We present the concept of a" conservation mediator" and how its use may help find a common ground between stakeholders and decision-makers in similar situations. (shrink)

Unlike the beatific knowledge, the infused knowledge does not belong intrinsically to the state of the comprehensor, for beatitude does not consist in a knowledge of created things in themselves, but in God;4 and unlike the acquired knowledge, the infused knowledge is not necessary for the assumption of an integral human nature.5 Add to this Thomas's passing description of Christ's infused knowledge as "proportioned to the angelic nature," encompassing all intelligible species of things knowable through nature and through the light of grace. In this vein, the infused knowledge threatens to transform Christ into a caricature of a man—turning Christ into what É. H. The knowledge of all that can be known by nature is already attributed to Christ through his acquired knowledge; further, the knowledge of all the mysteries of grace is accessible to Christ through his beatific knowledge of God and all things in Verbo. While humans, as viatores, gain knowledge through the senses, and, as comprehensores, behold God through an elevation of the soul through glory, it is unclear whether a third kind of knowledge, the infused knowledge, is necessary and, if so, to what end. If, according to the Scholastic dictum, God and nature do nothing in vain, what sense can be made of Christ's infused knowledge?At least since the seventeenth century, Thomists have typically sought to resolve this tension by appealing to the unique role of infused knowledge in Christ's earthly transmission of knowledge. In the Summa theologiae II-II, q. 2, a. 7, Aquinas argues that faith in the mystery of Christ is necessary "at all times and for all persons," even for those existing prior to the Fall into sin. This teaching appears to stand in tension with Aquinas's well-known position on the motive of the Incarnation. If, according to Aquinas, redemption from sin is the primary motive of the Incarnation, such that if humanity had not sinned God would not have become incarnate, (...) how to make sense of his teaching on the necessity of Adam's explicit faith in Christ prior to the Fall? In this paper, I explore the surprising development of Aquinas's teaching on Adam's faith from his early Scriptum on the Sentences to the Summa theologiae and show how his later teaching, far from betraying a momentary lapse in judgment, in fact highlights the strongly 'christocentric' character of his thought. Torrance seeks to uncover a common "Christocentrism" within the Byzantine tradition that challenges the contemporary tendency among contemporary Orthodox theologians to "unmoor" theological anthropology from the doctrine of the humanity of Christ. Indeed, according to Torrance, some of these approaches go so far as to risk the danger of "theological shipwreck" (1). As general representatives of the tendency Torrance has in mind, we can name such figures as John Zizioulas and Vladimir Lossky, whose personalist anthropologies depart from the tradition by "bypassing or deferring Christology" (10) In the case of Zizioulas, for instance, Torrance sees the disintegration of theological anthropology into "a sentimental application or projection of worldly and hazy concepts of personality and 'community' to both the Godhead and the people of God" (10). If, for Torrance, the above thinkers appear to represent a wayward tendency (even if he takes issue with certain of their "starting points," Torrance nevertheless seems to agree with most of their conclusions), it is Fr. John Behr whose theology Torrance likely has in mind as risking "theological shipwreck."As we shall see, the overall intelligibility of Torrance's work appears only in the final chapter, against the backdrop of Behr's "unmistakably Christocentric" (206) anthropology. While Torrance joins Behr in bemoaning the non-Christocentric character of much of modern theological anthropology, nevertheless, he sees Behr's project as positing a Christocentrism that flies in the face of the Byzantine tradition. In light of Behr's Christocentrism (and in a way that is reminiscent of Gaudium et Spes §22), Torrance wishes to [End Page 373] show that, for any genuinely Byzantine doctrine, Christ, in his particular and enduring humanity, must be the starting point of the human ideal: "Human perfection and human destiny are only revealed, known, and bequeathed in the person of Jesus Christ, the God-man" (11). In each of these thinkers Torrance discovers a "thoroughly Christocentric gaze" (37), which begins from the concrete and particular human nature of Christ, and thereby provides a contrast with the abstract tendency of certain contemporary Orthodox thinkers. However, as we shall see, on account of the ambiguity surrounding the term "Christocentric," it is not always clear whether or how Christ's humanity and human perfection figure into the themes discussed. Healthcare workers are often assumed to have a duty to work, even if faced with personal risk. This is particularly so for professionals. However, the health service also depends on non-professionals, such as porters, cooks and cleaners. The duty to work is currently under scrutiny because of the ongoing challenge of responding to pandemic influenza, where an effective response depends on most uninfected HCWs continuing to work, despite personal risk. This paper reports findings of a survey of HCWs conducted across (...) three National Health Service trusts in the West Midlands, UK, to establish whether HCWs’ likelihood of working during a pandemic is associated with views about the duty to work. The sense that HCWs felt that they had a duty to work despite personal risk emerged strongly regardless of professional status. Besides a strong sense that everyone should pull together, all kinds of HCWs recognised a duty to work even in difficult circumstances, which correlated strongly with their stated likelihood of working. This suggests that HCWs’ decisions about whether or not they are prepared to work during a pandemic are closely linked to their sense of duty. However, respondents’ sense of the duty to work may conflict with their sense of duty to family, as well as other factors such as a perceived lack of reciprocity from their employers. Interestingly, nearly 25% of doctors did not consider that they had a duty to work where doing so would pose risks to themselves or their families. (shrink)

The use of technology and teaching techniques derived from technology is currently a bourgeoning topic in higher education. Teachers at all levels and types of institutions want to know how these new technologies will affect what happens in and outside of the classroom. Many teachers have already embraced some of these technologies but remain uncertain about their educational efficacy. This brief tour of American law has demonstrated a little of the breadth and currency of legal liability actions which affect nursing. As health care changes and nursing roles change with it, so too will the nature of liability in this area. The American penchant for litigation is such that the chances of disentangling nurses from the continued onslaught of negligence litigation seem remote.

In the intersection between eugenics past and present, disability has never been far beneath the surface. Perceived and ascribed disabilities of body and mind were one of the core sets of eugenics traits that provided the basis for institutionalized and sterilization on eugenic grounds for the first 75 years of the 20th-century. Since that time, the eugenic preoccupation with the character of future generations has seeped into what have become everyday practices in the realm of reproductive choice. As Marsha Saxton (...) (2000) and Adrienne Asch (2000, 2003) have forcefully argued, the use of prenatal screening technologies to facilitate the selective abortion of fetuses with features that signify disabling traits—the paradigm here being trisomy 21 in a fetus indicating Down Syndrome in the child—express a negative view of such disabilities sufficient to warrant terminating an otherwise wanted pregnancy. The eliminative structure of what Rosemary Garland Thompson (2012) has called eugenic logic persists in contemporary practices governing reproductive choice, social inclusion, and democratic participation and their relationship to disability. The tie between eugenics and contemporary disability studies suggests that eugenics and reflection on its history can also play a more positive role in disability politics. After focusing on eugenics in the first half of the paper, we will shift in the second half of the paper to eugenic resonances in contemporary thought and practice, concluding with some thoughts about ongoing practices of silencing and the very idea of eradicating disability. This essay argues that Johannes von Kries analysis of the status in the criminal law of the rationally intending subject and the doctrine of _mens rea_ so closely associated with it (cf. Kries, 1886 ; 1888 ) was well known to Max Weber, who had initially trained in law, and highly significant both for the development of his sociology of subjective understanding and his parallel view that the social sciences must be jointly committed to combining a generalizing objective with an (...) individualizing method in their research. It also sees many indications that Weber believed that social scientific investigations could and should go further toward franchising the subject of such social research by encouraging active, even critical responses in his/her testimony in the interests of better achieving both causal and meaning adequacy. From this it would have been only a short step to what I call the practical activation of Alfred Schutz’s postulate of adequacy, which requires that intellectual type constructs in the social sciences not only make sense to research subjects but accord with their perceptions, observations and views. The essay discusses the obstacles provided by the environing authoritarian social and political framework, including the trajectories of those professions on which the social sciences had little choice but to model themselves, as reasons explaining why practical activation of the postulate of adequacy has not yet fully come to pass. It concludes by addressing new Weber scholarship which sees him as a complex and dynamic probabilist whose constructivist and interpretivist theory of human social action is based much more on _Chance_ and orientation than we thought, even to the point of being a model for practical activation of the postulate of adequacy as well as a new and revised basis for the analysis of social interaction itself (see Weber, [ 1913 ] ( 1981 ). In order to receive controlled pain medications for chronic non-oncologic pain, patients often must sign a “narcotic contract” or “opioid treatment agreement” in which they promise not to give pills to others, use illegal drugs, or seek controlled medications from health care providers. In addition, they must agree to use the medication as prescribed and to come to the clinic for drug testing and pill counts. Patients acknowledge that if they violate the opioid treatment agreement, they may no longer receive (...) controlled medications. OTAs have been widely implemented since they were recommended by multiple national bodies to decrease misuse and diversion of narcotic medications. But critics argue that OTAs are ethically suspect, if not unethical, and should be used with extreme care if at all. We agree that OTAs pose real dangers and must be implemented carefully. But we also believe that the most serious criticisms stem from a mistaken understanding of OTAs’ purpose and ethical basis. (shrink)

Most academic papers on ethics in pandemics concentrate on the duties of healthcare professionals. This paper will consider non-professional healthcare workers: do they have a moral obligation to work during an influenza pandemic? If so, is this an obligation that outweighs others they might have, e.g., as parents, and should such an obligation be backed up by the coercive power of law? This paper considers whether non-professional healthcare workers—porters, domestic service workers, catering staff, clerks, IT support workers, etc.—have an obligation (...) to work during an influenza pandemic. It uses data collected as part of a study looking at the attitudes of healthcare workers to working during a pandemic to suggest the philosophical arguments explored. These include: being in a position to do good, the ethics of work, competing obligations to family members and in particular to children and the obligations of citizens in a state of national emergency. We also look at whether compulsory measures are justified to support a national health service during a health emergency. We conclude that even if they are, compulsion should not be restricted to non-professionals who happen to be working in the health service at the time. Rather, compulsion involving a larger pool of people with the relevant skills and abilities is more equitable. (shrink)

Our primary goal was to develop and validate a task that could provide evidence about how humans learn praxis gestures, such as those involving the use of tools. To that end, we created a video-based task in which subjects view a model performing novel, meaningless one-handed actions with kinematics similar to praxis gestures. Subjects then imitated the movements with their right hand. Trials were repeated 6 times to examine practice effects. EEG was recorded during the task. As a control, subjects (...) watched videos of a model performing a well-established (over learned) tool-use gesture. These gestures were also imitated 6 times. Demonstrating convergent validity, EEG measures of task-related cortical activation were similar in topography and frequency between the novel gesture task and the overlearned, praxis gesture task. As in studies assessing motor skill learning with simpler tasks, cortical activation during novel gesture learning decreased as the same gestures were repeated. In the control condition, repetition of overlearned tool-use gestures were also associated with reductions in activation, though to a lesser degree. Given that even overlearned, praxis gestures show constriction of EEG activity with repetition, it is possible that that attentional effects drive some of the repetition effects seen in EEG measures of activation during novel gesture repetition. Background To describe the preferences for disclosure of individual biomarker results among mothers participating in a longitudinal birth cohort. Methods We surveyed 343 mothers that participated in the Health Outcomes and Measures of the Environment Study about their biomarker disclosure preferences. Participants were told that the study was measuring pesticide metabolites in their biological specimens, and that the health effects of these low levels of exposure are unknown. Participants were asked whether they wanted to receive their results and their child's (...) results. In addition, they were asked about their preferred method (letter vs in person) and format (more complex vs less complex) for disclosure of results. Results Almost all of the study participants wanted to receive their individual results (340/343) as well as their child's results (342/343). However, preferences for receiving results differed by education level. Mothers with less than a college degree preferred in-person disclosure of results more often than mothers with some college education or a college degree (34.3% vs 17.4% vs 7.9%, p<0.001). Similarly, mothers with less than a college education preferred a less complex disclosure format than mothers with some college education or a college degree (59.7% vs 79.1% vs 86.3%, p<0.0001). Conclusion While almost all study participants preferred to receive results of their individual biomarker tests, level of education was a key factor in predicting preferences for disclosure of biomarker results. To ensure effective communication of this information, disclosure of biomarker results should be tailored to the education level of the study participants. (shrink)

Nonpharmaceutical interventions to minimize the transmission of the severe acute respiratory syndrome coronavirus 2 are necessary because we currently lack a vaccine or specific treatments. Healthcare facilities have adopted visitor restrictions and masking requirements. These interventions should be evaluated as public health measures, focusing on their efficacy, the availability of less-restrictive alternatives, and the minimization of the burdens and their balance with the benefits. These interventions, as well as exceptions, can be justified by the same analysis. For example, visitor restrictions (...) are sound, as are exceptions for women in labor, adults with disabilities, minor children, and individuals who are dying. In implementing these policies, specific rules are preferable to general principles because they are more efficient and reduce possible bias. There should, however, be appeal mechanisms and retrospective review processes. Evaluating requests for medical exemptions to masking requirements is particularly difficult, given the prevalence of nonmedical objections, false claims of medical exemptions, and a lack of objective medical criteria. Requiring written statements by licensed healthcare providers that undergo subsequent substantive review may therefore be justified. (shrink)

A core value of Judaism is leading an ethical life. The Talmud, an authoritative source on Jewish law and tradition, has a number of discussions that deal with honesty in business and decision-making. One motive that can cause individuals to be unscrupulous is the presence of a conflict of interest. This paper will define, discuss, and review five Talmudic concepts relevant to conflict of interest. They are (1) Nogea B’Davar (being an interested party), (2) V’hiyitem N’keyim (behaving to ensure that (...) one is above suspicion) (3) Lifnei Iver (placing a stumbling block before the blind), (4) Shokhad (accepting a bribe), and (5) Geneivat Da’at (deception and undeserved goodwill). Case examples will be used to apply these Talmudic principles to contemporary business practice. This will include discussion of these Talmudic concepts as it applies to specific contemporary business examples relevant to the boardroom, accounting firms, investment banking, politics, and government. It may be impossible to eliminate all conflicts of interest. However, knowledge and awareness of these Talmudic principles can help individuals in business settings better address the ethical issues that they confront. (shrink)

The medial prefrontal cortex (mPFC) has been the subject of intense interest as a locus of cognitive control. Several computational models have been proposed to account for a range of effects, including error detection, conflict monitoring, error likelihood prediction, and numerous other effects observed with single-unit neurophysiology, fMRI, and lesion studies. Here, we review the state of computational models of cognitive control and offer a new theoretical synthesis of the mPFC as signaling response–outcome predictions. This new synthesis has two interacting (...) components. The first component learns to predict the various possible outcomes of a planned action, and the second component detects discrepancies between the actual and intended responses; the detected discrepancies in turn update the outcome predictions. This single construct is consistent with a wide array of performance monitoring effects in mPFC and suggests a unifying account of the cognitive role of medial PFC in performance monitoring. Working memory limits are best defined in terms of the complexity of the relations that can be processed in parallel. Complexity is defined as the number of related dimensions or sources of variation. A unary relation has one argument and one source of variation; its argument can be instantiated in only one way at a time. A binary relation has two arguments, two sources of variation, and two instantiations, and so on. Dimensionality is related to the number of chunks, because (...) both attributes on dimensions and chunks are independent units of information of arbitrary size. Studies of working memory limits suggest that there is a soft limit corresponding to the parallel processing of one quaternary relation. More complex concepts are processed by or In segmentation, tasks are broken into components that do not exceed processing capacity and can be processed serially. In conceptual chunking, representations are to reduce their dimensionality and hence their processing load, but at the cost of making some relational information inaccessible. Neural net models of relational representations show that relations with more arguments have a higher computational cost that coincides with experimental findings on higher processing loads in humans. Relational complexity is related to processing load in reasoning and sentence comprehension and can distinguish between the capacities of higher species. The complexity of relations processed by children increases with age. Implications for neural net models and theories of cognition and cognitive development are discussed. (shrink)
